terms of service

Effective Date: February 1, 2026

1. Introduction and Acceptance

Welcome to Wander. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Wander, LLC. ("Wander," "we," "us," or "our") governing your access to and use of the Wander platform, including:

Wander Explorer — our free travel planning tier
Wander Planner — our premium subscription service
Wander Community — our social platform for travelers

By accessing or using any Wander service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICES.

2. Definitions

For purposes of these Terms:

"Content" means any text, images, photos, reviews, itineraries, comments, and other materials uploaded, posted, or transmitted through the Services.
"Personal Data" has the meaning given under the EU General Data Protection Regulation (GDPR) and includes any information relating to an identified or identifiable natural person.
"Services" means all Wander products, features, applications, services, technologies, and software.
"User Content" means any Content that users submit, post, or transmit through the Services.
"Wanderer" means a registered user of the Wander Community platform.

3. Eligibility

3.1 AGE REQUIREMENTS

You must be at least 16 years of age to use the Services. If you are between 16 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Services with the consent of your parent or legal guardian, who must agree to these Terms on your behalf.

3.2 ACCOUNT REGISTRATION

To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Description of Services

4.1 WANDER EXPLORER (FREE TIER)

Wander Explorer provides limited access to our AI-powered travel planning tools, including:

One (1) AI-generated full itinerary per calendar quarter
Up to ten (10) destination recommendations
Five (5) basic chat modifications per itinerary
Travel type quiz and shareable badges
Access to the Wander Community

4.2 WANDER PLANNER (PREMIUM SUBSCRIPTION)

Wander Planner is a paid subscription service that provides enhanced features, including:

Four (4) AI-generated full itineraries per calendar quarter
Up to fifty (50) destination recommendations
Two hundred (200) chat modifications per itinerary
Complex modifications (multi-city replanning, trip extensions, points optimization)
Booking integration with third-party platforms
Group travel planning with collaborative voting and payment splitting
Dream Mode with price drop alerts
Priority response speed and support

4.3 WANDER COMMUNITY

Wander has a social platform where Wanderers can share travel experiences, including uploading reviews and photos, publishing itineraries, earning achievement stickers, participating in traveler rankings, and connecting with other users.

5. Subscriptions, Fees, and Payment

5.1 SUBSCRIPTION TERMS

Wander Planner is offered on a monthly or annual subscription basis. Subscription fees are charged in advance at the beginning of each billing cycle. Current pricing is available at wander.ai/pricing.

5.2 AUTOMATIC RENEWAL

YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

5.3 REFUND POLICY

Subscription fees are generally non-refundable. However, if you are located in the European Union, you have the right to withdraw from your subscription within 14 days of purchase without providing any reason, subject to applicable exceptions under EU consumer protection law. 5.4 PRICE CHANGES

We reserve the right to modify subscription pricing. Any price changes will be communicated at least thirty (30) days before taking effect and will apply to billing cycles beginning after the notice period.

6. User Content and Conduct

6.1 YOUR CONTENT

You retain ownership of any User Content you submit to the Services. By submitting User Content, you grant Wander a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and improving the Services.

6.2 CONTENT REPRESENTATIONS

You represent and warrant that you own or have the necessary rights to submit your User Content and that your User Content does not violate the rights of any third party, including intellectual property rights, privacy rights, or publicity rights.

6.3 PROHIBITED CONDUCT & CONDUCT

You agree not to post, upload, or transmit any Content that:

Is unlawful, defamatory, obscene, pornographic, harassing, threatening, or hateful
Infringes any intellectual property or other proprietary rights
Contains viruses, malware, or other harmful code
Constitutes spam, unauthorized advertising, or solicitation
Impersonates another person or entity
Violates the privacy of any third party
Otherwise violates applicable law or these Terms

6.4 CONTENT MODERATION

We reserve the right, but have no obligation, to monitor, edit, or remove any User Content at our sole discretion. We may also suspend or terminate accounts that violate these Terms.

7. Intellectual Property

7.1 WANDER’S INTELLECTUAL PROPERTY

The Services and all content and materials included therein, including but not limited to the Wander logo, designs, text, graphics, software, and AI-generated itineraries ("Wander Content"), are owned by or licensed to Wander and are protected by copyright, trademark, and other intellectual property laws.

7.2 LIMITED LICENSE

Subject to your compliance with these Terms, Wander grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes.

7.3 RESTRICTIONS

You may not: (a) copy, modify, or distribute Wander Content; (b) reverse engineer, decompile, or disassemble any part of the Services; (c) use automated means to access the Services without our permission; (d) use the Services for any commercial purpose without our written consent; or (e) remove any copyright or proprietary notices.

8. Third-Party Services and Bookings

8.1 THIRD-PARTY INTEGRATIONS

The Services may integrate with or provide links to third-party services, including, without limitation, booking platforms, payment processors, and travel providers. Your use of such third-party services is subject to their respective terms and privacy policies.

8.2 BOOKING DISCLAIMER

WANDER DOES NOT PROVIDE TRAVEL SERVICES DIRECTLY. When you book accommodations, flights, tours, or other travel services through links or integrations in our platform, your contract is with the third-party provider, not Wander. We are not responsible for the quality, safety, or legality of any travel services provided by third parties.

9. Privacy and Data Protection

9.1 PRIVACY POLICY

Our collection, use, and protection of your Personal Data is governed by our Privacy Policy, available at wander.ai/privacy. By using the Services, you consent to our data practices as described in the Privacy Policy.

9.2 GDPR COMPLIANCE

For users in the European Economic Area (EEA), the United Kingdom, and Switzerland, we process Personal Data in accordance with the General Data Protection Regulation (GDPR) and applicable local data protection laws. Our legal bases for processing include:

Contract Performance: Processing necessary to provide the Services you requested
Legitimate Interests: Processing for our legitimate business interests, such as improving the Services and preventing fraud
Consent: Processing based on your explicit consent, which you may withdraw at any time
Legal Obligation: Processing necessary to comply with applicable laws

9.3 YOUR DATA RIGHTS (GDPR)

If you are located in the EEA, UK, or Switzerland, you have the following rights regarding your Personal Data:

Right of Access: You may request a copy of the Personal Data we hold about you

9.4 INTERNATIONAL DATA TRAN

When we transfer data internationally, we implement appropriate safeguards, including Standard Contractual Clauses approved by the European Commission, to ensure your data receives an adequate level of protection.

9.5 DATA RETENTION

We retain your Personal Data only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. When you delete your account, we will delete or anonymize your Personal Data within 90 days, except where retention is required by law.

10. AI-Generated Content Disclaimer

The Services use artificial intelligence to generate travel recommendations, itineraries, and other content. While we strive for accuracy, AI-generated content may contain errors, omissions, or outdated information.

YOU ACKNOWLEDGE AND AGREE THAT:

AI-generated recommendations are for informational purposes only and do not constitute professional travel advice
You are responsible for independently verifying all information, including opening hours, prices, availability, and safety conditions
Wander is not liable for any losses or damages arising from reliance on AI-generated content
Travel conditions and regulations may change; always check official sources before traveling

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We make no guarantees regarding the accuracy, reliability, or completeness of any content, including AI-generated recommendations.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WANDER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO WANDER IN THE TWELVE (12) MONTHS BEFORE THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these Terms excludes or limits our liability that cannot be excluded or limited by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Wander and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

14. Termination

14.1 TERMINATION BY YOU

You may terminate your account at any time by using the account deletion feature in your settings or by contacting info@wanderaway.ai. Upon termination, your right to use the Services will immediately cease.

14.2 TERMINATION BY WANDER

We may suspend or terminate your account and access to the Services at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. We will provide notice where practicable.

14.3 EFFECT OF TERMINATION

Upon termination, all licenses granted to you will terminate, and you must cease all use of the Services. Sections 6-13, 15, and 16 shall survive termination.

15. Dispute Resolution

15.1 GOVERNING LAW

These Terms and any dispute arising out of or related to these Terms or the Services shall be governed by the laws of the State of New York, United States, without regard to its conflict of laws principles.

15.2 ARBITRATION AGREEMENT (U.S. Users)

FOR USERS IN THE UNITED STATES: You and Wander agree to resolve any disputes through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. YOU AND WANDER WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

15.3 EUROPEAN UNION USERS

If you are a consumer in the European Union, you may also be entitled to bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under mandatory consumer protection laws. The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. General Provisions

16.1 MODIFICATIONS TO TERMS

We may modify these Terms at any time by posting the revised Terms on our website. For material changes, we will provide notice via email or through the Services at least thirty (30) days prior to the changes taking effect. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms.

16.2 ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other agreements incorporated by reference, constitute the entire agreement between you and Wander regarding the Services and supersede all prior agreements.

16.3 SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.4 WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.5 ASSIGNMENT

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

16.6 FORCE MAJEUR

Wander shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, government actions, or internet disruptions.
